1. Overview/Sweepstakes Period: The UScellular® “2023 Summerfest Social” Sweepstakes (the “Sweepstakes”), sponsored by UScellular (the “Sponsor”), begins on June 15, 2023 at 7:00 p.m. Central Time (“CT”) and ends on June 29, 2023 at 11:59:59 p.m. CT (the “Sweepstakes Period”).
There will be three (3) separate opportunities to enter the Sweepstakes during the Sweepstakes Period, as described in Rule 3, below (each, an “Entry Period”). For each Entry Period, there will be a corresponding separate, individual random drawing to award the prizes described in Rule 5, below. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to abide by and be bound by these Official Rules and Sponsor’s decisions, which shall be final and binding in all matters related to the Sweepstakes. The Sweepstakes is void outside the states listed in Rule 2, below and where prohibited by law.
2. Eligibility: The Sweepstakes is open only to legal residents of Illinois, Iowa, Michigan, Minnesota, and Wisconsin who: (a) are at least 18 years of age at time of entry; and (b) are registered users of Instagram with a personal, publicly viewable account. If you do not have an Instagram account, you may open one free of charge at Instagram.com. Your account may not be a shared or corporate account. Please note: You must keep the Instagram handle you used to enter through the date on which the prizes are awarded.
Employees, officers and directors of UScellular, Summerfest and their respective subsidiaries, affiliates, authorized agents, sales representatives, distributors, advertising and promotional agencies, and members of the immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate in this Sweepstakes. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification.
3. How to Enter: On each the following dates and times— June 15, 2023 at 12:00 p.m. (Noon) CT, June 22, 2023 at 12:00 p.m. (Noon) CT, and June 26, 2023 at 12:00 p.m. (Noon) CT— the Sponsor will post a unique post in connection with this Sweepstakes on its Instagram account @UScellular. Each post will invite eligible individuals to leave a specific comment on the post within three (3) days of the original posting (inclusive of the posting date). Follow all instructions to leave an appropriate comment (your “Comment” or “entry”), and you will be entered into the appropriate prize drawing described in Rule 5, below. Comments for the June 15, 2023 post must be received by 11:59:59 p.m. CT on June 18, 2023; Comments for the June 22, 2023 post must be received by 11:59:59 p.m. CT on June 25, 2023; and Comments for the June 26, 2023 post must be received by 11:59:59 p.m. CT on June 29, 2023. Your Comment must comply with the Comment Requirements and Restrictions described in Rule 4, below. Limit one (1) entry per person/Instagram account per Entry Period. Non-winning entries in an individual drawing will not be included in subsequent drawings.
If you choose to enter using a mobile device, standard message and data rates apply in accordance with your personal mobile service plan. Check details of your plan prior to using a mobile device to enter. A mobile device is not required to enter the Sweepstakes.
Comments will not be judged. Winners will be selected in random drawings as described in Rule 5, below. Any attempt by any individual to exceed the above-indicated entry limit by using multiple/different e-mail or IP addresses, Instagram accounts, identities, or any other methods will void that individual's entry(ies) and that individual will be disqualified. In the event of dispute as to the identity or eligibility of a potential winner, the winning entry will be declared made by the "Authorized Account Holder" of the Instagram account used to enter the Sweepstakes provided he/she is eligible according to these Official Rules. The “authorized account holder” is the natural person in whose name the Instagram account was created.
4. Comment Requirements and Restrictions: Each Comment must conform to the following Requirements/Restrictions:
Comment cannot: (a) be derogatory of any ethnic, racial, gender, religious, professional or age group; (b) promote alcohol, marijuana, illegal drugs, tobacco, or any activities that may be unsafe or dangerous; (c) be offensive (in the opinion of the Sponsor), or endorse any form of hate or hate group; (d) defame, misrepresent or disparage Sponsor or its products/services, or other people, products, services or companies; (e) contain trademarks owned by others (except Sponsor’s trademarks to the limited extent allowed hereunder*), or advertise or promote any brand or product of any kind (except Sponsor’s brand), without permission, or contain any personal identification, (other than that of the entrant as may be required for the Comment), such as license plate numbers, personal names, email addresses or street addresses; (f) contain copyrighted materials owned by others without permission; (g) communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and (h) be unsuitable for family audiences and for public display and dissemination, in the sole opinion of Sponsor.
The above list is not meant to be exhaustive. If a Comment is determined by Sponsor, in its sole discretion, to be in violation of any of the foregoing requirements, or unsuitable for inclusion in this Sweepstakes for any reason, the Comment and related entrant will be disqualified from the Sweepstakes. *LIMITED LICENSE: THE SPONSOR’S TRADEMARKS MAY BE USED FOR PURPOSES OF THIS SWEEPSTAKES ONLY. NO OTHER RIGHTS IN OR TO SPONSOR’S TRADEMARKS ARE GRANTED UNDER THESE OFFICIAL RULES. Note: Use of Sponsor’s trademarks/brand in Comments is optional.
By submitting a Comment, entrant hereby warrants and represents as follows: (i) Comment conforms to all Requirements and Restrictions set forth herein; (j) Comment is entrant’s original creation (modifying, enhancing or altering a third party’s preexisting work does not qualify as a entrant’s original creation); (k) Comment was created solely by entrant; (l) Comment has not been previously published or won any awards; (m) Comment does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; and (n) publication of the Comment, or portions thereof, via various media, including Web posting, will not infringe on the rights of any third party. Each entrant hereby releases, indemnifies, and holds Sponsor harmless from and against any claims contrary to the above warranties and representations.
All incomplete or non-compliant Comments, and the entrants who submitted them, will be disqualified.
5. Prize Drawings/Prizes/Odds: On or about each of the following dates — 6/19/2023, 6/26/202, and 6/302023 — Sponsor will conduct a separate random drawing from among all eligible entries received during the corresponding Entry Period to select eight (8) potential winners of the following prize package: Each verified winner will receive two (2) one (1)-day Summerfest General Admission tickets (for winner and one (1) guest) on a date to be determined by Sponsor. The Approximate Retail Value (“ARV”) of each prize is $52. A total of twenty-four (24) prizes will be awarded, with a total ARV of $1,248. The awarding of each prize is subject to verification of each winner’s eligibility and compliance with these Official Rules. The odds of winning a prize depend on the number of eligible entries received for each individual drawing.
Each winner’s guest must be eighteen (18) years of age or older, subject to the following limited exception: A guest may be a minor if s/he is the child or legal ward of the winner. The prizes consist only of the items described above. All other expenses related to the acceptance and use of the prize that are not specified above as being included in the prize will be the responsibility of each winner. Such expenses include but are not limited to transportation, parking, lodging, meals, beverages, and souvenirs. Alcohol beverages will be available at the Summerfest event. If a winner chooses to consume alcohol beverages, s/he will be solely responsible for any consequences related thereto. Any behavior by a winner that the Sponsor deems disruptive or inappropriate, or that is prohibited by the Summerfest event operators, may result in the winner being ejected from the event site at the discretion of the Sponsor or the event operators. Each winner is encouraged to comply with all state, federal and local guidelines and/or mandates pertaining to Covid-19 and attendance at mass public events.
6. Winner Notification/Prize Claim: Each winner will be notified by Instagram direct message within approximately two (2) days following the date of the drawing in which s/he was selected and may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within a specified time period as a condition of receiving his/her prize. At Sponsor’s discretion, guests may also be required to sign and return Liability/Publicity Releases as a condition of accompanying winners.
Failure to comply will result in disqualification and forfeiture of the prize. If disqualified, the winner’s prize will be awarded to an alternate winner from among all remaining entries in the applicable drawing pool (time permitting). If necessary, this process will be repeated up to three (3) times (time permitting). If the prize is not claimed by the third attempt to award it, the prize will not be awarded.
Prizes cannot be transferred, assigned, substituted, sold, offered at auction, or redeemed for cash except at Sponsor’s sole discretion or as described herein. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. All federal, state, and local income taxes on the prizes are the responsibility of each winner.
General Admission tickets will be emailed to each winner within approximately two (2) days following confirmation of each winner’s eligibility.
7. Release: Acceptance of a prize constitutes winner’s consent to Sponsor’s use of his/her name, limited biographical information, city and state, voice, statements and/or filmed, taped or otherwise recorded likeness in commerce and in all media worldwide, including but not limited to social media, for advertising/publicity/trade purposes without additional compensation, notice or approval except where prohibited by law.
By submitting an entry, you warrant and represent that you have complied with all of these Official Rules, and agree to release Sponsor, Meta Platforms, Instagram, Summerfest and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion agencies and the directors, officers, employees and agents of each of the foregoing (collectively the “Released Parties”) from and against any and all claims and liability for any injuries, including but not limited to personal injury, Covid-19 transmission, death, loss or damage of any kind arising from or in connection with participation in the Sweepstakes, the acceptance, possession, use and or misuse of a prize or participation in prize-related activities, if applicable (including all travel related thereto), and/or claims based on right of publicity/right of privacy or defamation.
8. Rights Granted to Sponsor: By submitting a Comment, each entrant hereby grants to the Sponsor a non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly or privately perform, publish, edit, delete, make derivative works from or display such Comment, or any portion thereof, in any media worldwide, including but not limited to the internet, without compensation or limitation and without any further notice or right of approval. Each entrant agrees that the results and proceeds of such use shall become the property of Sponsor and shall be freely assignable by Sponsor. Sponsor is not obligated to use any of the above-mentioned right. Each entrant releases and holds Sponsor harmless from and against any and all claims or liability arising from or in connection with any use of entrant’s Comment. Each entrant further acknowledges that Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than the Comment.
Each entrant expressly waives all rights to review or approve any use that Sponsor makes of his/her Comment in accordance with these Official Rules. By submitting a Comment, each entrant further agrees to waive all rights of attribution if his/her Comment is used by Sponsor or anyone Sponsor authorizes, and to waive any moral rights in the Comment.
By submitting a Comment, each entrant further agrees that his/her Comment is gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligations other than those contained in these Official Rules, and that Sponsor is free to disclose the ideas contained in the Comment on a non-confidential basis to anyone. Each entrant further acknowledges that he/she will not instigate, support, maintain, or authorize any action or lawsuit against Sponsor on the basis that any use of his/her Comment infringes any of his/her rights as creator of such Comment.
By submitting a Comment, each entrant understands and acknowledges that he/she will not now or in the future be paid or compensated in any way for the Comment or for granting the Sponsor any of the rights set out in these Official Rules.
Sponsor may, at any time, require any entrant to execute documents to confirm the grant of rights hereunder; failure to do so may result in disqualification.
9. Miscellaneous: The Released Parties are not responsible for: (a) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, or not received by Sponsor for any reason; (b) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for deletion, theft or destruction of, unauthorized access to, or alteration of, entries; (c) failed or unavailable hardware, network, or software; (d) causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; (e) any entries submitted in a manner that is not expressly allowed under these Official Rules (all such entries will be disqualified); (f) incorrect or inaccurate entry information whether caused by entrants, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (g) any typographical or other error in any printing or advertising relating to the Sweepstakes, in the administration or execution of the Sweepstakes, or in the announcement of the prize winners; or (h) cheating or fraud by any participant.
If, for any reason, the Sweepstakes cannot be executed as planned, including but not limited to any printing, administrative, human or other error of any kind, transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, pandemic, social media mandate or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Sweepstakes, or if the Sweepstakes is compromised or becomes corrupted in any way, electronically or otherwise, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and, if terminated before the intended end date of the Sweepstakes Period, to select the potential winners in a random drawing from among all eligible, non-suspect entries received for the Entry Period then in progress prior to the date/time of termination.
Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules or any laws, or to be attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, misappropriation, infringement, or any other unfair playing practices or poor sportsmanship, or to be acting with the intention of annoying, abusing, threatening, or harassing any other participants or Sponsor.
10. Privacy: Any personally identifiable information collected in connection with an entrant’s participation in this Sweepstakes will be used by Sponsor, its affiliates, and agents only for purposes of the proper administration and fulfillment of the Sweepstakes, as described in these Official Rules, and in any manner consistent with Sponsor’s Privacy Policy, available at uscellular.com/site/privacy/index.html.
11. Disputes/Venue/Governing Law: By participating, entrants agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or the prizes, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal, state or local court located in Cook County, Illinois; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Sweepstakes , but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will entrant be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of Illinois or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than Illinois.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials or made by Sponsor’s representatives, and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
12. Severability: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

3. How to Enter: During the Sweepstakes Period, the Sponsor will post a Summerfest logo on its Instagram account @UScellular, Twitter account @UScellular and Facebook account facebook.com/uscellular. Follow all instructions to leave an appropriate comment on the post (your “Comment” or “entry”), and you will be entered into the prize drawing described in Rule 5, below. Your Comment must comply with the Comment Requirements and Restrictions described in Rule 4, below. Limit one (1) entry per person for the entire Sweepstakes Period regardless of the social media platform on which you enter.
If you choose to enter using a mobile device, standard message and data rates apply in accordance with your personal mobile service plan. Check details of your plan prior to using a mobile device to enter. A mobile device is not required to enter the Sweepstakes.

The Approximate Retail Value (“ARV”) of each prize is $52. Total ARV of all prizes: $416. The awarding of each prize is subject to verification of each winner’s eligibility and compliance with these Official Rules. The odds of winning a prize depend on the number of eligible entries received.
Each winner’s guest must be eighteen (18) years of age or older, subject to the following limited exception: A guest may be a minor if s/he is the child or legal ward of the winner. 1. Overview/Sweepstakes Period: The UScellular® “2023 Summerfest National Smile Day” Sweepstakes (the “Sweepstakes”), sponsored by UScellular (the “Sponsor”), begins on May 31, 2023 at 11:00 a.m. Central Time (“CT”) and ends on June 5, 2023 at 11:59:59 p.m. CT (the “Sweepstakes Period”).
The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to abide by and be bound by these Official Rules and Sponsor’s decisions, which shall be final and binding in all matters related to the Sweepstakes. The Sweepstakes is void outside the states listed in Rule 2, below and where prohibited by law.
2. Eligibility: The Sweepstakes is open only to legal residents of Illinois, Iowa, Michigan, Minnesota, and Wisconsin who: (a) are at least 18 years of age at time of entry; and (b) are registered users of Instagram, Twitter, or Facebook with a personal, publicly viewable account. If you do not have an Instagram, Twitter or Facebook account you may open one free of charge at Instagram.com, Twitter.com or Facebook.com. Your account may not be a shared or corporate account. Please note: You must keep the Instagram, Twitter or Facebook handle you used to enter through the date on which the prizes are awarded.
Employees, officers and directors of UScellular, Summerfest and their respective subsidiaries, affiliates, authorized agents, sales representatives, distributors, advertising and promotional agencies, and members of the immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate in this Sweepstakes. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification.
3. How to Enter: During the Sweepstakes Period, the Sponsor will post a Summerfest logo on its Instagram account @UScellular, Twitter account @UScellular and Facebook account facebook.com/uscellular. Follow all instructions to leave an appropriate comment on the post (your “Comment” or “entry”), and you will be entered into the prize drawing described in Rule 5, below. Your Comment must comply with the Comment Requirements and Restrictions described in Rule 4, below. Limit one (1) entry per person for the entire Sweepstakes Period regardless of the social media platform on which you enter.
If you choose to enter using a mobile device, standard message and data rates apply in accordance with your personal mobile service plan. Check details of your plan prior to using a mobile device to enter. A mobile device is not required to enter the Sweepstakes.
Comments will not be judged. Winners will be selected in a random drawing as described in Rule 5, below.
Any attempt by any individual to exceed the above-indicated entry limit by using multiple/different e-mail or IP addresses, Instagram accounts, identities, or any other methods will void that individual's entry(ies) and that individual will be disqualified. In the event of dispute as to the identity or eligibility of a potential winner, the winning entry will be declared made by the "Authorized Account Holder" of the Instagram, Twitter or Facebook account used to enter the Sweepstakes provided he/she is eligible according to these Official Rules. The “authorized account holder” is the natural person in whose name the applicable social media account was created.
4. Comment Requirements and Restrictions: Each Comment must conform to the following Requirements/Restrictions:
Comment cannot: (a) be derogatory of any ethnic, racial, gender, religious, professional or age group; (b) promote alcohol, marijuana, illegal drugs, tobacco, or any activities that may be unsafe or dangerous; (c) be offensive (in the opinion of the Sponsor), or endorse any form of hate or hate group; (d) defame, misrepresent or disparage Sponsor or its products/services, or other people, products, services or companies; (e) contain trademarks owned by others (except Sponsor’s trademarks to the limited extent allowed hereunder*), or advertise or promote any brand or product of any kind (except Sponsor’s brand), without permission, or contain any personal identification, (other than that of the entrant as may be required for the Comment), such as license plate numbers, personal names, email addresses or street addresses; (f) contain copyrighted materials owned by others without permission; (g) communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and (h) be unsuitable for family audiences and for public display and dissemination, in the sole opinion of Sponsor.
The above list is not meant to be exhaustive. If a Comment is determined by Sponsor, in its sole discretion, to be in violation of any of the foregoing requirements, or unsuitable for inclusion in this Sweepstakes for any reason, the Comment and related entrant will be disqualified from the Sweepstakes. *LIMITED LICENSE: THE SPONSOR’S TRADEMARKS MAY BE USED FOR PURPOSES OF THIS SWEEPSTAKES ONLY. NO OTHER RIGHTS IN OR TO SPONSOR’S TRADEMARKS ARE GRANTED UNDER THESE OFFICIAL RULES. Note: Use of Sponsor’s trademarks/brand in Comments is optional.
By submitting a Comment, entrant hereby warrants and represents as follows: (i) Comment conforms to all Requirements and Restrictions set forth herein; (j) Comment is entrant’s original creation (modifying, enhancing or altering a third party’s preexisting work does not qualify as a entrant’s original creation); (k) Comment was created solely by entrant; (l) Comment has not been previously published or won any awards; (m) Comment does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; and (n) publication of the Comment, or portions thereof, via various media, including Web posting, will not infringe on the rights of any third party. Each entrant hereby releases, indemnifies and holds Sponsor harmless from and against any claims contrary to the above warranties and representations.
All incomplete or non-compliant Comments, and the entrants who submitted them, will be disqualified.
5. Prize Drawings/Prizes/Odds: On or about 6/6/2023, Sponsor will conduct a random drawing from among all eligible entries received to select eight (8) potential winners of the following prize package: Each verified winner will receive two (2) one (1)-day Summerfest General Admission tickets for (winner and one (1) guest) on a date to be determined by Sponsor. The Approximate Retail Value (“ARV”) of each prize is $52. Total ARV of all prizes: $416. The awarding of each prize is subject to verification of each winner’s eligibility and compliance with these Official Rules. The odds of winning a prize depend on the number of eligible entries received.
Each winner’s guest must be eighteen (18) years of age or older, subject to the following limited exception: A guest may be a minor if s/he is the child or legal ward of the winner. The prizes consist only of the items described above. All other expenses related to the acceptance and use of the prize that are not specified above as being included in the prize will be the responsibility of each winner. Such expenses include but are not limited to transportation, parking, lodging, meals, beverages, and souvenirs. Alcohol beverages will be available at the Summerfest event. If a winner chooses to consume alcohol beverages, s/he will be solely responsible for any consequences related thereto. Any behavior by a winner that the Sponsor deems disruptive or inappropriate, or that is prohibited by the Summerfest event operators, may result in the winner being ejected from the event site at the discretion of the Sponsor or the event operators.
6. Winner Notification/Prize Claim: Each winner will be notified by Instagram Direct Message within approximately two (2) days following the date of the drawing and may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (where permissible) within a specified time period as a condition of receiving his/her prize. At Sponsor’s discretion, guests may also be required to sign and return Liability/Publicity Releases as a condition of accompanying winners. Failure to comply will result in disqualification and forfeiture of the prize. If disqualified, the winner’s prize will be awarded to an alternate winner from among the remaining entries (time permitting).
Prizes cannot be transferred, assigned, substituted, sold, offered at auction, or redeemed for cash except at Sponsor’s sole discretion or as described herein. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. All federal, state, and local income taxes on the prizes are the responsibility of each winner.
General Admission tickets will be emailed to each winner within approximately two (2) days following confirmation of each winner’s eligibility.
7. Release: Acceptance of a prize constitutes winner’s consent to Sponsor’s use of his/her name, limited biographical information, city and state, voice, statements and/or filmed, taped or otherwise recorded likeness in commerce and in all media worldwide, including but not limited to social media, for advertising/publicity/trade purposes without additional compensation, notice or approval except where prohibited by law.
By submitting an entry, you warrant and represent that you have complied with all of these Official Rules, and agree to release Sponsor, Meta Platforms, Instagram, Summerfest and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion agencies and the directors, officers, employees and agents of each of the foregoing (collectively the “Released Parties”) from and against any and all claims and liability for any injuries, including but not limited to personal injury, Covid-19 transmission, death, loss or damage of any kind arising from or in connection with participation in the Sweepstakes, the acceptance, possession, use and or misuse of a prize or participation in prize-related activities, if applicable (including all travel related thereto), and/or claims based on right of publicity/right of privacy or defamation.
8. Rights Granted to Sponsor: By submitting a Comment, each entrant hereby grants to the Sponsor a non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly or privately perform, publish, edit, delete, make derivative works from or display such Comment, or any portion thereof, in any media worldwide, including but not limited to the internet, without compensation or limitation and without any further notice or right of approval. Each entrant agrees that the results and proceeds of such use shall become the property of Sponsor and shall be freely assignable by Sponsor. Sponsor is not obligated to use any of the above-mentioned right. Each entrant releases and holds Sponsor harmless from and against any and all claims or liability arising from or in connection with any use of entrant’s Comment. Each entrant further acknowledges that Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than the Comment.
Each entrant expressly waives all rights to review or approve any use that Sponsor makes of his/her Comment in accordance with these Official Rules. By submitting a Comment, each entrant further agrees to waive all rights of attribution if his/her Comment is used by Sponsor or anyone Sponsor authorizes, and to waive any moral rights in the Comment.
By submitting a Comment, each entrant further agrees that his/her Comment is gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligations other than those contained in these Official Rules, and that Sponsor is free to disclose the ideas contained in the Comment on a non-confidential basis to anyone. Each entrant further acknowledges that he/she will not instigate, support, maintain, or authorize any action or lawsuit against Sponsor on the basis that any use of his/her Comment infringes any of his/her rights as creator of such Comment.
By submitting a Comment, each entrant understands and acknowledges that he/she will not now or in the future be paid or compensated in any way for the Comment or for granting the Sponsor any of the rights set out in these Official Rules.
Sponsor may, at any time, require any entrant to execute documents to confirm the grant of rights hereunder; failure to do so may result in disqualification.
9. Miscellaneous: The Released Parties are not responsible for: (a) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, or not received by Sponsor for any reason; (b) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for deletion, theft or destruction of, unauthorized access to, or alteration of, entries; (c) failed or unavailable hardware, network, or software; (d) causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; (e) any entries submitted in a manner that is not expressly allowed under these Official Rules (all such entries will be disqualified); (f) incorrect or inaccurate entry information whether caused by entrants, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (g) any typographical or other error in any printing or advertising relating to the Sweepstakes, in the administration or execution of the Sweepstakes, or in the announcement of the prize winners; or (h) cheating or fraud by any participant.
If, for any reason, the Sweepstakes cannot be executed as planned, including but not limited to any printing, administrative, human or other error of any kind, transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, pandemic, social media mandate or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Sweepstakes, or if the Sweepstakes is compromised or becomes corrupted in any way, electronically or otherwise, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and, if terminated before the intended end date of the Sweepstakes Period, to select the potential winners in a random drawing from among all eligible, non-suspect entries received prior to the date/time of termination.
Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules or any laws, or to be attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, misappropriation, infringement, or any other unfair playing practices or poor sportsmanship, or to be acting with the intention of annoying, abusing, threatening, or harassing any other participants or Sponsor.
10. Privacy: Any personally identifiable information collected in connection with an entrant’s participation in this Sweepstakes will be used by Sponsor, its affiliates, and agents only for purposes of the proper administration and fulfillment of the Sweepstakes, as described in these Official Rules, and in any manner consistent with Sponsor’s Privacy Policy, available at uscellular.com/site/privacy/index.html.
11. Disputes/Venue/Governing Law: By participating, entrants agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or the prizes, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal, state or local court located in Cook County, Illinois; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Sweepstakes , but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will entrant be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of Illinois or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than Illinois.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials or made by Sponsor’s representatives, and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
12. Severability: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
